Wrongful-death suit against tour operator dismissed

The Massachusetts Supreme Judicial Court has dismissed a lawsuit against tour operator GWV International, in which a Massachusetts couple sought damages after the death of their diabetic daughter.

The 20-year-old woman became fatally ill during a GWV vacation in the Dominican Republic. 

Massachusetts' top court said the case must be pursued in the Dominican Republic because the standard of medical care provided at the destination is a primary issue. GWV in 2006 had won a summary judgment dismissing the case, but that was overturned.

GWV attorney Rodney Gould said he expects the final decision to be cited frequently in future disputes involving injuries or illnesses outside the U.S.
