Sabre told a U.S. District Court in New York that US Airways’ antitrust claims against Sabre should be extinguished because “virtually identical” claims by American Airlines against Sabre were settled in 2012.
On Dec. 9, US Airways merged with American, making US Airways “subject to the American/Sabre settlement agreement,” Sabre wrote to U.S. District Judge Lorna Schofield.
Sabre said that that agreement “specifically binds American’s subsidiaries and any entity that merges or consolidates with American — including US Airways — and therefore precludes US Airways’ requests for injunctive relief and at least certain damages.”
US Airways disagreed in a response to Judge Schofield.
“Sabre’s proposed amendment — and its attempt to leverage its American settlement to avoid scrutiny of its product — go too far,” wrote US Airways.
US Airways said that Sabre and American could have negotiated to have US Airways drop its case when US Airways and American merged, but they did not.
