FORT LAUDERDALE, Fla. -- A bankruptcy judge here granted partial
summary judgment to a travel agency in a suit brought against it by
the bankruptcy trustee of Renaissance Cruises, which is attempting
to recover commissions on un-sailed cruises.
The trustee had asserted that travel agencies should turn over
commissions on the un-sailed cruises because the commissions were
advance payments made by Renaissance to the agents and, therefore,
property of the bankruptcy estate, according to a statement from
ASTA, which has provided assistance to some agents in the
Renaissance case.
"By granting summary judgment on this count, the court ruled
that the trustee is not entitled to pursue the recall under this
section," ASTA said.
The judge denied without prejudice the agency's motion for a
summary judgment on three other counts for collection asserted by
the trustee.
The agency, Accent on Travel, is one of about 3,000 agents sued
by the Renaissance trustee in an attempt to recoup commissions,
said ASTA president Richard Copland.
